A CHARTER ORDINANCE OF THE CITY OF IOLA, EXEMPTING THE CITY OF IOLA, KANSAS FROM THE PROVISIONS OF K.S.A.14-101 to K.S.A. 14-310, INCLUSIVE, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT, RELATING TO A COMMISSION FORM OF GOVERNMENT.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF IOLA, KANSAS:
SECTION 1. The City does hereby adopt Charter Ordinance No 17 of the Code of the City of Iola, to read as follows:
WHEREAS, K.S.A. 14-101 to 14-310, inclusive, authorizes a city to implement a council form of government, which provisions are not uniformly applicable to all cities; and
WHEREAS, pursuant to Article 12, Section 5 of the Constitution of the State of Kansas, cities may exempt them from such provisions and provide substitute and additional provisions therefore;
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF IOLA, KANSAS:
Section 1: The City of Iola, Kansas, a city of the second class, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt itself from and makes inapplicable to it the provisions of K.S.A. 14-101 to 14-310, inclusive, and to provide substitute and additional provisions as hereinafter set forth in this Ordinance. The referenced provisions are either enactments or parts thereof which are applicable to this City, but are not applicable uniformly to all cities.
Section 2: The purpose of this ordinance is to specifically adopt a Five (5) commission style of government and shall be conducted in accordance with those statutes governing a commission style of government, which are not inconsistent with this charter ordinance.
Section 3: As used in this Ordinance, the following words and phrases shall be defined as follows: Commission: shall mean a mayor and four (4) commissioners to form a five (5) member commission. The mayor is to be elected at large and each commissioner shall be elected from one of each of the four wards of the City; they shall be elected for a term of four (4) years, after the initial election, and shall hold their offices until their successors are qualified. For the initial election, the Mayor and the two commissioners who win their respective wards and receive the two highest vote totals, in the first election, shall serve four (4) year terms and the two commissioners who win the election in the other two wards but are third and fourth in total votes shall serve an initial two (2) year term. Treasurer: shall mean a person appointed by the Commission for a two (2) year term at the same time other appointments to City offices are made; Appointed Officers: shall mean all other positions within the city which may be appointed by statute and will serve for a period of two (2) years and said compensation to be set by agreement of the parties.
